We process personal data in particular for the following purposes:

Depending on the nature of the specific processing activity, we process personal data primarily on the basis of:

• performance of a contract or taking steps at the request of the data subject prior to entering into a contract, where processing is necessary to provide AMP, process an order or provide the requested access;
• compliance with a legal obligation, particularly in connection with accounting and tax records;
• our legitimate interest, particularly in ensuring security, technical operation, protecting our rights, handling user requests and reasonable development of the service;

Where processing is based on consent, you may withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

6 | AMICA AI AND PROCESSING OF COMMUNICATION

Amica AI is part of the AMP system and is operated through the Buddy Pro platform.
When communicating with Amica AI, the content of messages may be processed by automated systems for the purpose of generating a response and ensuring continuity of communication.

6.1 Principle of limited access

AMP operates on the principle of limited Provider access to the User’s personal communications.

The content of personal conversations between the User and Amica AI is not normally accessible to the Provider, its employees or collaborators as readable communication.

The content of communications is technically processed by automated systems to the extent necessary for the operation of the service, generation of Amica AI responses and provision of platform functions.

According to the current terms of the BuddyPro platform, data are stored in encrypted form and access to them is restricted by the technical architecture of the platform. For certain parts of the platform, limited exceptions may apply due to legal obligations or the need to investigate and resolve a security incident.

7 | SHARED MEMORY WITHIN BUDDY PRO

Amica AI is operated on the Buddy Pro platform, which enables the creation of different AI entities under different brands.

The platform uses shared memory about the user within its AI environment. If the user therefore communicates with another AI entity created on the BuddyPro platform using the same Telegram account or the same other account within the platform, those AI entities may use information stored in the shared memory to provide consistent and personalized communication.

Shared memory is limited to user profile information and information derived from the user’s interactions. It does not include know-how, uploaded content or the configuration of a specific AI entity as shared content. Information derived from communications may, however, also contain references to topics the user discussed with a specific AI entity and the identification of that AI entity.

Personal data in shared memory are processed automatically and stored in encrypted form. According to BuddyPro’s terms, they are not accessible to other owners of AI entities or other users. Provider personnel do not normally have access to the content of shared memory and such access is limited to cases where it is necessary to comply with a legal obligation or to investigate and resolve a security incident; such access is logged.

This functionality follows from the current terms of the BuddyPro platform. Shared memory is an integral part of the platform’s technical architecture.

When providing AI functions, however, some content sent to Amica AI may, to the extent necessary, also be temporarily processed by AI service providers located outside the EEA that BuddyPro uses through APIs. According to BuddyPro’s terms, such data are not retained by these providers for the purpose of training their AI models.

For such transfers, BuddyPro states that it uses the mechanisms provided under GDPR rules for transfers of personal data to third countries, in particular the European Commission’s Standard Contractual Clauses (SCCs) or, where the relevant provider is certified, the adequacy framework under the EU-US Data Privacy Framework.

Current information about AI service providers, their locations and the transfer mechanisms used is provided in BuddyPro’s list of subprocessors.

10 | RETENTION OF PERSONAL DATA

We retain personal data only for as long as necessary for the purpose for which it was collected or for the period required by law.
The specific retention period depends on the type of data and the purpose of processing.
In particular:

• data necessary to provide the service is retained for the duration of the user account or provision of the relevant service;
• data related to subscriptions and orders is retained for as long as necessary to administer the contractual relationship;
• data contained in tax and accounting documents is retained for the period required by applicable laws;
• data obtained through contact and interest forms is retained for as long as necessary to process the request and related follow-up communication, or for a period corresponding to another legal basis for continued retention.

After the applicable retention period expires, we delete or anonymize personal data unless further retention is required by law or is necessary to protect our rights.
Data processed through Amica AI may also be subject to technical limitations related to the architecture of the platform and Telegram. An individual message cannot always be removed from the Telegram bot solely because the user deleted it in Telegram. For shared memory, access to data, their rectification and deletion are governed by the rules of the BuddyPro platform and its privacy policy.

11 | DATA SECURITY

We use appropriate technical and organizational measures to protect personal data against unauthorized access, loss, destruction, alteration or other misuse.

Data processed through Amica AI are protected within the platform infrastructure by encryption during transmission and storage.

In BuddyPro shared memory, personal data are processed automatically and stored in encrypted form. The platform states that it does not provide an ordinary interface through which owners of AI entities or other users can access these data.
